Privacy Statement for On-Site Contractors

This statement lets on-site contractors know what personal information Cairn use, and why:

  • whilst working on one of our sites
  • when participating in our apprenticeship scheme

 

How we use your personal information

Meeting legal obligations

We use your personal information where necessary to make sure our legal obligations are met in respect of your work on our sites, including:

  • our health & safety responsibilities to you, your fellow workers and others;
  • ensuring the safety and security of others, their property and personal information;
  • responsibilities in respect of the collection and payment of taxes; and
  • detecting and reporting crimes or unlawful activity.

 

Cairn’s legitimate interests

Some of your personal information is used in our legitimate business interests for the effective management of our activities:

  • measuring, monitoring, and managing sub-contractor performance, delivery, and contractual obligations;
  • implementing and maintaining best practice;
  • identifying and managing risks; and
  • implementing and maintaining responsible working practices.

 

We make sure we have considered and balanced the potential impact on you. Where we process your personal information for purposes we consider to be in our legitimate interest, you have the right to object. You can do this by emailing us. However, this may prevent you from being able to work on our sites.

 

Personal information not obtained from you

Some personal information we use may not have been obtained from you but may be generated by us or provided to us by your employer or other third parties:

  • operational records, such as times you entered and left a site;
  • training and competency records, such as outstanding training, training outcomes and competency levels;
  • performance records, such as quality appraisals, foreman records, and feedback;
  • site disciplinary records, including investigations, outcomes, and sanctions;
  • health & safety records, including records related to accidents, investigations, and outcomes; and
  • information in connection with legal and insurance claims.

If you are part of our apprenticeship scheme, your employer will provide us with your name and details of the education institute you are completing your studies, as well as the results of those studies. We use this information in our legitimate business interests for administering the payment of our apprenticeship support, and for monitoring the success of the scheme.

 

Fingerprints and Facial Images

Access to our sites may be controlled by turnstiles operated using your fingerprint or facial image. Your fingerprint or facial image details are kept securely and can be used only for confirming or denying entry to our sites. Use of your fingerprint or facial image is only with your explicit consent which you can withdraw at any time by emailing us at: privacy@cairnhomes.com.

 

CCTV

Areas of our sites are protected by CCTV. Images are used only for meeting our health & safety obligations to you, or in our legitimate interests of identifying, preventing and investigating unsafe acts or criminal behaviour, or supporting the making or defence of legal claims. Personal information relating to health

It is likely we will process personal information relating to your health:

  • health & safety records, including records related to accidents, investigations, and outcomes;
  • sickness and absence records that disclose information relating to your health; and
  • information concerning your health in the context of our management of your wellbeing or performance.

 

We do this only:

  • when necessary to carry out our obligations, or exercise our rights; or
  • to protect our legal position.

 

Who else receives your personal information?

We may share your personal information with the third parties detailed below. It is not shared with anyone else.

Your employer

We may share your personal information with your employer or person who contracted you, for the reasons set out above.

Government authorities

We may provide any of your personal information to relevant authorities, such as the Revenue Commissioners or Gardai, where necessary to meet any legal obligations we have or to exercise or defend our legal rights.

Information technology and systems

Information technology and software service providers are used by Cairn to support its activities. These third parties can only use the personal information we share in order to provide their services to us.

Professional advisers and other service providers

We use third parties to provide services, advice and products. We may provide them with personal information so those services, advice or products can be supplied to us.

 

Transfers of personal data

Some of our service providers will process your personal data on our behalf outside of the European Union. We keep such transfers to a minimum but in all cases ensure that the transfers meet the requirements of data protection law. How long do we keep this personal information?

Unless stated otherwise, we keep your personal information for at least the period we are legally required to retain it. Otherwise, the longest we will hold your personal information is for three years after the site is completed or, if sooner, when we consider we no longer require the personal information.

 

CCTV

CCTV images are kept for no more than thirty days, or if required for longer (for example to defend a legal claim), for the period advised to us by our professional advisers.

 

Fingerprints and Facial Recognition

Fingerprint and facial recognition data is retained for a period of eight weeks after the date you were last on the relevant site.

 

Your rights

You have the right to:

  • access your personal information;
  • require us to delete it;
  • rectify any personal information we hold that is incorrect; and/or
  • have your personal information transmitted to another data controller.

 

If you want to exercise these rights please let us know, preferably in writing. You will need to provide enough information to verify and complete your request. We will complete your request within thirty days, subject to any legal or other requirements that requires us not to complete your request, in which case we shall inform you of this where we can.
