Privacy Statement for Commercial Contractors

This statement lets our contractors know what personal information Cairn uses, and why, as part of our commercial relationship.

Refer to the “Privacy Statement for on-site contractors” for details of how personal information is used in connection with individuals’ on-site activities.

 

Personal information Cairn Homes uses

In our commercial relationship with you as a contractor we will use your personal information. This will include:

  • your name and contact details (phone number, email address, and business address); and
  • (where you are a sole trader or partner) details of your business obtained from you directly or from publicly available sources (including financial details, credit history, VAT number, tax compliance, service and delivery performance, and health & safety performance).

 

If you represent or work for a contractor then, where relevant, your personal information (like your name and contact details, role, responsibility, and dealings with us), will be used in accordance with this statement but only in the context of the contractor’s appointment by Cairn.

 

How we use your personal information

 

Meeting contractual obligations

Where you are a sole trader or partner of a business appointed by us, we will use we use your personal information where necessary to:

  • take steps prior to entering into a contract with you; and
  • manage all aspects of the performance of the contract between you and Cairn Homes, including in respect of obligations that continue after your work for us has been completed (such as warranties).

 

Meeting legal obligations

We also use your personal information where necessary to make sure our legal obligations are met in respect of your work on our sites, including:

  • our health & safety responsibilities to you, your employees, and others;
  • ensuring the safety and security of others, their property and personal information;
  • responsibilities in respect of the collection and payment of taxes; and
  • detecting and reporting crimes or unlawful activity.

 

Cairn Homes legitimate interests

Some of your personal information is used in our legitimate business interests for the effective management of our activities:

  • measuring, monitoring, and managing your (or your employer’s) performance, delivery, and contractual obligations;
  • implementing and maintaining best practice;
  • identifying and managing risks; and
  • implementing and maintaining responsible working practices.

 

Who else receives your personal information?

We may share your personal information with the third parties detailed below. It is not shared with anyone else and is not transferred outside the European Union (unless otherwise stated).

 

Homeowners or Owners’ Management Companies

As part of the handover of a development, the details of key suppliers and service providers will be provided to homeowners or Owners’ Management Companies. This is so those suppliers can be contacted for future maintenance or remediation requirements. You will be asked to confirm the details to be provided. If these details include your personal information, we will transfer them to the homeowners or Owner’s Management Companies in our legitimate business interests.

 

Your employer

We may share your personal information with your employer or person who contracted you, for the reasons set out above.

 

Government authorities

We may provide any of your personal information to relevant authorities, such as the Revenue Commissioners, where necessary to meet any legal obligations we have or to exercise or defend our legal rights.

 

Information technology and systems

Information technology and software service providers are used by Cairn Homes to support its activities. These third parties can only use the personal information we share in order to provide their services to us.

 

Professional advisers and other service providers

We use third parties to provide services, advice, and products. We may provide them with personal information so those services, advice or products can be supplied to us.

 

How long do we keep this personal information?

Unless stated otherwise, we keep your personal information for at least the period we are legally required to retain it. Otherwise, the longest we will hold your personal information is for up to twelve years after the site is completed, or if sooner, when we consider we no longer require the personal information.

 

Your rights

You have the right to:

  • access your personal information;
  • require us to delete it;
  • rectify any personal information we hold that is incorrect; and/or
  • have your personal information transmitted to another data controller.

 

If you want to exercise these rights please let us know, preferably in writing. You will need to provide enough information to verify and complete your request. We will complete your request within thirty days, subject to any legal or other requirements that requires us not to complete your request, in which case we shall inform you of this where we can.

 

Legitimate interest

Where we use your personal information for our legitimate business interests, we make sure we have considered and balanced the potential impact on you. You have the right to object to our using your personal information on this basis. You can do this by emailing us.
